Due to the stormwater regulation requirements by the Wisconsin Department of Natural Resources, the City of Kenosha created the Kenosha Stormwater Utility (SWU). The SWU will enforce and implement the programs needed to in order to be in compliance with the Wisconsin Pollutant Discharge and Elimination System (WPDES) permit. The WPDES permit requires each municipality to impose regulations on new developments and redevelopments within their city limits. A Post-Construction Stormwater Management Ordinance (Chapter 36) has been created to ensure compliance with Stormwater Management Plan criteria and long-term maintenance of the facilities.

The Post-Construction Stormwater Management Ordinance requires new development and redevelopment projects within the City of Kenosha to include numerous additional criteria to their planning process. These requirements have been summarized in a Stormwater Management Plan Worksheet that can be used to aid in determining the sections of the ordinance that may apply to a particular site. The Stormwater Utility has also adopted a revised City of Kenosha Stormwater Management Criteria that will need to be reviewed and incorporated into the site‘s Stormwater Management Plan.

All plans submitted for a plan review process will be required to apply for a Stormwater Management Permit. The application should be submitted to the Kenosha Stormwater Utility. This permit will also begin the process of authorizing the site for additional permits needed by other departments.

A requirement of the Stormwater Management Permit is that all applicants must have a long-term Maintenance Agreement Application filed with the Stormwater Utility. The application and any necessary information must be submitted for review before an agreement can be drafted. The Stormwater Utility will draft the agreement for the developer.
